Cover for using the vehicle in Europe Unless you ask us to extend your cover and pay any additional premium required, the cover for using the vehicle abroad is restricted to the minimum required by law; it does not include loss or damage to the vehicle, and may provide more limited cover for your liability to others. This cover is provided in the following countries: European Union: Austria, Belgium, Denmark, Finland, France, Germany, Greece, Italy, Luxembourg, Netherlands, Portugal, Republic of Ireland, Spain, Sweden and Other European Countries: Croatia, the Czech Republic, Hungary, Iceland, Norway, Slovak Republic, Slovenia, Switzerland and Any other country whose arrangements follow EU insurance directives and are approved by the Commission of the EU. If, before you depart and subject to our approval, you do ask us to extend your cover and you pay the additional premium and accept and additional terms we will extend this policy to to cover your use of the vehicle in certain other European countries; we will advise you of the countries concerned when you contact us. Own damage If the vehicle is lost, stolen, damaged or destroyed, we will at our option either 1) pay for this vehicle to be repaired by a repairer of our choice or 2) pay you the market value of the vehicle (the damaged or lost vehicle will then belong to us) or 3) pay the cash value of any lost or stolen part. We will also pay reasonable costs for the protection, removal and storage of the vehicle and delivery after repair to the risk address. We may use warranted replacement parts which are not supplied by the manufacturer of the vehicle. If suitable replacement parts are not available we will pay the manufacturer's last list price. accessories We will pay for the loss of or damage to accessories of this vehicle when fitted to the vehicle (including the maker's standard tool kit and the vehicle's safety equipment) excluding trailers, any sound equipment, tools of the trade, personal belongings and goods being transported. sound equipment If the sound equipment fitted to this vehicle is lost or damaged we will at our option either replace it with equipment to the standard normally fitted by the manufacturer or pay you what we would pay for such replacement. The most we will pay is £500 less any excess which applies. about the excesses on this policy The excess for claims under this section will be: In respect of Sound Equipment - £100 In respect of window glass only - £75 In respect of all other claims - £100 plus the greatest of the following amounts which apply Where at the time of the incident the driver: - is under 25 years of age - £200 - holds a provisional licence or has held a full licence for less than 12 months - £150 arbitration If we accept a claim under this section of the policy but cannot agree the amount to be paid we will pass the matter on to an arbitrator who will be appointed in accordance with the law in force at the time. The arbitrator must have made a decision before you can take legal action against us. Own damage exclusions This section of your policy does not provide cover for: 1) the first amount of each claim shown under 'about the excess on this policy' 2) wear and tear or depreciation. 3) mechanical, electrical, electronic or computer failures or breakdowns. 4) damage caused by the process of cleaning, modification, repairing or restoring or by any gradually operating cause. 5) damage to tyres caused by punctures, cuts, bursts or application of brakes. 6) costs resulting from loss of use. 7) that part of the cost of repair or replacement which improves the insured property beyond its condition immediately before the loss or damage incurred. 8) incidents occurring outside the United Kingdom unless you have advised us that cover is required outside the United Kingdom and the premium for such an extension is paid. 9) reduction in the value of this vehicle following repair. 10) any loss arising in connection with any fraud or deception. 11) loss of or damage to the vehicle which arises as a result of any agreement or transaction involving the vehicle. 12) loss or damage arising from the vehicle being filled with the wrong fuel. 13) loss of or damage to the vehicle by theft or malicious damage unless this has been reported to the police and a crime reference number obtained. 14) loss or damage resulting from your vehicle being taken without your permission by a member of your family, or anyone who normally lives with you. 15) loss or damage caused directly by pressure waves caused by aircraft and other aerial devices travelling at or above the speed of sound 16) loss or damage caused by fire if the vehicle is equipped for cooking of food and/or heating drink 17) any other damage resulting from the vehicle being moved by you after fire or theft. 18) any storage charges unless you tell us about them and we agree in writing to pay for them. 19) keys, keyless entry system devices, tapes, cassettes, compact and mini discs, citizen band radios, phones or phone equipment 20) any loss or damage to any trailer or caravan whether or not it is being towed or attached to the vehicle 21) any increase in damage as a result of the vehicle being moved under its own power following an accident | |||

Liability to third parties We will pay any amounts, up to the limits set out below, for which the Regular Driver is legally liable as a result of: (i) accidental death of or injury to persons and (ii) accidental damage to property up to £1 million caused by or arising out of the vehicle in the United Kingdom. We will also pay for any such liability arising out of the towing of any trailer or disabled vehicle other than for reward. Third Party Exclusions Liability to Third Parties cover does not insure: 1 the loss or damage to the vehicle or any trailer or vehicle being towed; 2 any amount above £1,000,000 for damage to other people's property; 3 the loss of or damage to property, or injury to animals, belonging to or held in trust by or in the custody or control of the person responsible for the damage and who is claiming the protection of this policy; 4 the liability of any person who is entitled to equivalent protection under any other contract of insurance; 5 any liability arising from the use of vehicle in that part of an airport or aerodrome provided for the take-off and landing of aircraft or for the movement or parking of aircraft on the ground; 6 loss or damage to any bridge, weighbridge, viaduct, road, or other surface over which the vehicle is driven, or anything under the surface, caused by the weight or vibration of the vehicle or its load; 7 any liability arising from pollution or contamination unless the pollution or contamination is directly caused by a sudden identifiable unintended and unexpected incident which occurs in its entirety in a specific time and place during the period of insurance. This exception will not apply where such cover is necessary to meet the requirements of compulsory motor insurance legislation; 8 any liability in respect of death, injury or damage caused or arising beyond the limits of any carriageway or thoroughfare in connection with: i) the bringing of the load to the vehicle for loading thereon; or ii) the taking away of the load from the vehicle after unloading. 9 any loss, damage or liability caused by pollution or contamination arising out of the seepage or spillage of the load from the vehicle or movement of the load in the vehicle; 10 any consequence whatsoever resulting directly or indirectly from or in connection with any of the following regardless of any other contributory cause or event, except to the extent that we are liable under the Road Traffic Acts or Orders (i) Terrorism Terrorism is defined as any act or acts including but not limited to (a) the use or threat of force and/or violence and/or (b) harm or damage to life or to property (or the threat of such harm or damage) including but not limited to harm or damage by nuclear and/or chemical and/or biological and/or radiological means caused or occasioned by any person(s) or group(s) of persons or so claimed in whole or in part for political, religious, ideological or similar purposes (ii) any action taken in controlling preventing suppressing or in any way relating to (i) above Where we are liable under the Road Traffic Acts or Orders, the maximum amount we will pay for damage to property as a result of any accident or accidents caused by a vehicle or vehicles driven or used by you or any other person and for which cover is provided under this section will be (i) the third party property damage limit specified in the policy or £5,000,000 whichever is the lower in respect of all claims consequent on one originating cause; or (ii) such greater sum as may in the circumstances be required by the Road Traffic Acts or Orders. | |||

General Policy Terms Amending this insurance If you wish to make a change to this policy simply inform us of the change you wish to make. If we agree to the change, we will also agree on the effective date of the change and no period of notice is required Your obligations as the policy holder Failure to comply with any of the following conditions may invalidate your cover. 1 You must ensure that: 1.1 the vehicle is kept in a roadworthy condition. 1.2all reasonable steps are taken to safeguard the vehicle against loss or damage. 1.3the vehicle is locked, windows and other openings are closed, any required security devices are activated and all keys and keyless entry system devices are removed when it is left unattended. 1.4we are supplied with true and complete information about the vehicle and the insured drivers and any incident of loss or damage which may involve us as your insurers. 1.5all reasonable requests made by us are complied with. 1.6the police are notified within 48 hours of you or the Regular Driver becoming aware of any incident involving theft, attempted theft, or malicious damage and a crime reference number is obtained. 1.7no costs are incurred and no admission of liability, offer or settlement is made to a third party without our consent. 1.8the vehicle has a current MOT certificate if applicable. 2 We must be notified as soon as possible of: 2.1a change of address for where the vehicle is normally kept overnight (the risk address). 2.2you or the Regular Driver becoming aware of any accident or loss involving this vehicle or of any other incident which may lead to a claim by you or by a third party. Employers Indemnity Extension If this vehicle is insured for business use and the accident is on a road or public place as defined in the Road Traffic Acts or Orders, we will pay any amount for which the employer or business partner of the regular Driver or the Regular Driver's spouse becomes legally liable as a result of the use of this vehicle by the Regular Driver or the Regular Driver's spouse in the course of their business or employment. Emergency treatment We will pay as required by the Road Traffic Acts and Orders for emergency treatment for injuries arising out of the use of the vehicle Posthumous indemnity Following the death of any person entitled to indemnity we will, in respect of the liability incurred, indemnify such person's legal personal representatives. Legal Expenses If you are charged with an offence or face a civil lawsuit following an accident you should contact us. If the incident could lead to a claim against this policy we may take over the Legal Expenses. | |||
General exclusions This policy does not insure: 1 loss, damage, destruction, injury or liability: 1.1 arising while the vehicle is being driven by any person i) not covered by your Certificate of Motor Insurance and/or ii) who does not hold or comply with the conditions of a valid licence to drive such a vehicle in the country and at the time of the incident other than any holder of a foreign driver's licence who is specifically named as a permitted driver on this policy 1.2 arising while the vehicle is being used other than for the purposes shown in your Certificate of Motor Insurance 1.3 deliberately caused by any person entitled to indemnity under this policy or any person acting on their behalf 1.4 arising from any incident occurring in any period in which any premium or any instalment in payment of any premium is unpaid and overdue 1.5 caused by the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component or of any nuclear fuel or any nuclear waste 1.6 caused directly or indirectly by war, invasion, act of enemy hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power other than to meet the requirements of the Road Traffic Acts or Orders 1.7 1.8 resulting from confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any government or public or legal authority caused by riot, civil commotion or any act of terrorism occurring elsewhere than in England, Scotland, Wales, the Isle of Man or the Channel Islands caused directly or indirectly by carrying hazardous goods caused by earthquake or subterranean fire 1.9 1.10 occuring when the vehicle is towing (i) for reward a caravan, trailer or disabled mechanically propelled vehicle or (ii) more than one caravan, trailer or mechanically propelled vehicle at any one time; while the vehicle is being used to carry passengers or goods in a way that is likely to affect the safe driving or control of the vehicle in the respect of anyone who does not meet all the conditions of this policy; 1.11 1.12 1.13 1.14 1.15 resulting from anything sold, transported or supplied by you or on your behalf; caused by ashes from the vehicle, or from any trailer or machinery attached to it or detached from it; caused by or arising from the operation of the vehicle (or of plant forming part of the vehicle or attached to it) as a tool of trade; liability arising from any agreement or contract unless that liability would have existed otherwise consequential loss other than that which may arise under Liability to Third parties Except to the extent that we are liable under the Road Traffic Acts or Orders, this policy does not cover any consequence whatsoever resulting directly or indirectly from or in connection with any of the following regardless of any other contributory cause or event (i) (ii) war invasion act of foreign enemy hostilities or a war like operation or operations (whether war be declared or not) civil war rebellion revolution insurrection civil commotion assuming the proportions of or amounting to an uprising military or usurped power any action taken in controlling preventing suppressing or in any way relating to (i) above Third Party Exclusions Liability to Third Parties cover does not insure: the loss or damage to the vehicle or any trailer or vehicle being towed; any amount above £1,000,000 for damage to other people's property; the loss of or damage to property, or injury to animals, belonging to or held in trust by or in the custody or control of the person responsible for the damage and who is claiming the protection of this policy; 1 2 3 4 5 the liability of any person who is entitled to equivalent protection under any other contract of insurance; any liability arising from the use of vehicle in that part of an airport or aerodrome provided for the take-off and landing of aircraft or for the movement or parking of aircraft on the ground; 6 7 loss or damage to any bridge, weighbridge, viaduct, road, or other surface over which the vehicle is driven, or anything under the surface, caused by the weight or vibration of the vehicle or its load; any liability arising from pollution or contamination unless the pollution or contamination is directly caused by a sudden identifiable unintended and unexpected incident which occurs in its entirety in a specific time and place during the period of insurance.
